These Terms and Conditions set out the basis on which Waste Removal Bloomsbury provides waste collection and associated services to residential and commercial customers. By booking a collection, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business, or organisation requesting the services.

Company means Waste Removal Bloomsbury.

Services means any waste collection, removal, clearance, loading, transport, or related service provided by the Company.

Waste means any items, materials, or refuse presented by the Customer for removal, whether household, commercial, garden, or other non-hazardous waste, unless expressly agreed otherwise.

Contract means the agreement between the Customer and the Company for the supply of Services in accordance with these Terms and Conditions.

2. Scope of Services

The Company provides scheduled and one-off waste collection and removal services within its operating area, including Bloomsbury and surrounding districts. The specific nature of the Services, including type of waste accepted, approximate collection time, and pricing, will be confirmed at the time of booking.

Unless otherwise agreed in writing, the Services do not include dismantling of fixtures, specialist lifting, deep cleaning, or the removal of hazardous, clinical, or prohibited waste. The Company reserves the right to refuse any waste that is unsafe to handle, not as described at the time of booking, or not permitted under applicable waste regulations.

3. Booking Process

3.1 Bookings may be made by telephone or email with the Company. A booking is an offer by the Customer to purchase the Services in accordance with these Terms and Conditions.

3.2 When you make a booking, you must provide accurate and complete information, including but not limited to:

a. The collection address and any access restrictions.

b. The type and approximate volume or weight of waste.

c. Any items that may require special handling or present safety concerns.

d. Your contact details and preferred collection date and time window.

3.3 The Company will confirm acceptance of your booking verbally or in writing. The Contract between you and the Company is formed when the Company confirms the booking. The Company may decline a booking at its discretion.

3.4 The Customer is responsible for ensuring that someone is present at the collection address during the agreed time window, or that the Company has clear and lawful access to the waste. If the Company is unable to complete the collection due to lack of access, the Company may charge a missed attendance fee.

4. Service Standards and Access

4.1 The Company will use reasonable endeavours to arrive within the agreed time window, but timing is not guaranteed. Delays may occur due to traffic, weather, operational issues, or circumstances beyond the Companys reasonable control.

4.2 The Customer must ensure that the collection location is safe, accessible, and suitable for the Companys personnel and vehicles. The Customer must provide clear instructions regarding access, parking arrangements, and any restrictions such as loading bays, height limits, or congestion rules.

4.3 If a permit, parking permission, or access authorisation is required, the Customer is responsible for obtaining it, unless otherwise agreed. Any fines or penalties arising directly from incorrect information or instructions provided by the Customer may be charged to the Customer.

4.4 The Company may photograph the waste before and after collection for internal records, regulatory compliance, and to assist in resolving any disputes.

5. Waste Description and Prohibited Items

5.1 The Customer must accurately describe the waste at the time of booking. If, upon arrival, the actual waste differs significantly from the description, the Company may adjust the price, refuse to remove some or all items, or treat the booking as cancelled by the Customer.

5.2 The following items are generally prohibited unless the Company has specifically agreed to accept them and the Customer has provided full and accurate information in advance:

a. Hazardous or special waste, including but not limited to solvents, chemicals, asbestos, batteries in bulk, oils, gas cylinders, and clinical waste.

b. Explosives, firearms, weapons, or ammunition.

c. Pressurised containers or items that are unsafe to transport.

d. Any waste for which the Customer does not hold lawful title or permission to dispose of.

5.3 If prohibited or unsafe items are discovered at the time of collection, the Company may refuse to handle them and may charge a call-out or partial service fee. The Company may also report any suspected illegal activity to the relevant authorities.

6. Pricing and Payments

6.1 Prices for the Services are generally based on the type, volume, and weight of waste, the labour involved in loading, and distance or access considerations. Indicative prices may be provided at the time of booking, subject to confirmation on site.

6.2 Unless otherwise agreed, the Customer must pay all charges in full on completion of the collection, using an accepted payment method. Payment may be required in advance for some bookings, for example larger clearances or commercial contracts.

6.3 If the volume or nature of waste collected differs from the initial estimate, the Company will explain any change in price before proceeding. If the Customer does not agree to the revised price, the Company may cancel the Service and apply a reasonable attendance or cancellation charge.

6.4 For account or invoiced Customers, payment terms will be confirmed in writing. If no terms are specified, payment is due within 14 days from the date of invoice. The Company reserves the right to charge interest on overdue sums at the applicable statutory rate and recover reasonable costs of pursuing late payments.

6.5 All prices are quoted inclusive or exclusive of VAT as expressly stated. The Customer is responsible for any applicable taxes, surcharges, or levies imposed by law.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by contacting the Company. To avoid charges, cancellations or significant changes should be made with as much notice as possible, and at least 24 hours before the scheduled collection time wherever practicable.

7.2 The Company reserves the right to charge a cancellation fee if the Customer:

a. Cancels less than 24 hours before the scheduled collection time.

b. Fails to provide access to the collection address at the agreed time.

c. Fails to present the waste for collection as agreed.

7.3 The Company may cancel or reschedule a booking at any time if:

a. The Customer is in breach of these Terms and Conditions.

b. Conditions at the site are unsafe or unsuitable.

c. The waste is materially misdescribed, hazardous, or prohibited.

d. Operational or regulatory reasons prevent the Service from being carried out.

7.4 In the event of cancellation by the Company, any sums paid in advance for Services not provided will normally be refunded, except where the Customer is at fault under these Terms and Conditions.

8. Customer Obligations

8.1 The Customer is responsible for:

a. Providing accurate information at booking and on site.

b. Ensuring lawful ownership or authority to dispose of the waste.

c. Ensuring safe and reasonable access for the Companys staff and vehicles.

d. Complying with all relevant laws and regulations relating to the waste.

8.2 The Customer must not ask the Companys staff to undertake any act that is unsafe, unlawful, or outside the agreed scope of the Services. The Companys staff may decline such requests at their absolute discretion.

9. Company Responsibilities and Liability

9.1 The Company will perform the Services with reasonable care and skill and in accordance with applicable UK waste management regulations and duty of care obligations.

9.2 The Companys liability for loss or damage arising from the provision of the Services is limited as follows:

a. The Company is not liable for any loss of profit, loss of business, loss of opportunity, or any indirect or consequential loss.

b. The Company is not liable for pre-existing damage or defects to property or items at the collection site.

c. The Companys total liability for any claim arising out of or in connection with the Contract, whether in contract, tort including negligence, or otherwise, is limited to the price paid or payable by the Customer for the specific Service giving rise to the claim.

9.3 Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded or limited.

9.4 The Customer must notify the Company in writing of any alleged loss or damage as soon as reasonably practicable and in any event within 7 days of the completion of the relevant Service, providing reasonable evidence. The Company may inspect the site and request further information before reaching a decision.

10. Waste Handling and Environmental Regulations

10.1 The Company will handle, transport, and dispose of waste in accordance with its legal obligations under UK law, including any applicable environmental, health and safety, and waste carrier regulations.

10.2 The Company will endeavour to maximise reuse and recycling of collected materials, where practicable, and will transport waste only to appropriately licensed facilities or transfer stations.

10.3 Title to the waste transfers to the Company at the point of collection, provided that the Customer has full lawful authority to dispose of it. If it is later discovered that the Customer did not have such authority, the Customer will indemnify the Company in respect of any claims, costs, or liabilities arising.

10.4 The Customer acknowledges that certain items may require segregated disposal or incur additional processing costs in order to comply with regulations. Any such requirements and related charges will be communicated by the Company where reasonably practicable.

11. Data Protection and Privacy

11.1 The Company may collect and process personal data such as names, contact details, and addresses in order to provide the Services, manage bookings, and handle accounts or queries.

11.2 Personal data will be processed in accordance with applicable data protection laws and used only for legitimate business purposes, including service delivery, administration, and compliance with legal obligations.

11.3 The Company may retain records of bookings, payments, and waste collections for a reasonable period for accounting, regulatory, and operational reasons.

12. Complaints and Dispute Resolution

12.1 If you are dissatisfied with any aspect of the Services, you should contact the Company as soon as possible, providing your name, collection address, date of service, and a clear description of your concern.

12.2 The Company will investigate complaints and seek to resolve them fairly and promptly. Where appropriate, the Company may offer a partial refund, re-attendance, or other reasonable remedy.

12.3 If a dispute cannot be resolved directly between the parties, either party may consider using mediation or other forms of alternative dispute resolution before commencing legal proceedings.

13. Variations to Terms

13.1 The Company may amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to that Contract.

13.2 Any variation to these Terms and Conditions requested by the Customer will only be effective if agreed by the Company in writing.

14. Force Majeure

14.1 The Company is not liable for any failure or delay in performing its obligations where such failure or delay results from events outside its reasonable control, including but not limited to extreme weather, traffic disruption, industrial action, accidents, emergencies, or changes in law or regulation.

14.2 If a force majeure event substantially prevents the Company from providing the Services, the Company may cancel the booking without liability, subject to refunding any sums paid in advance for Services not provided.

15. Severability

15.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, illegal, or unenforceable, that provision will be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable.

15.2 Any such modification or deletion will not affect the validity and enforceability of the remaining provisions.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, are governed by and construed in accordance with the laws of England and Wales.

16.2 The courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by the Company.
